The Applicants failed to prove that the Respondent had disobeyed the court order of 23rd June 2014. The existence of a genuine dispute as to the location of the excavation relative to the Applicants' parcels rendered the contempt application unmerited. Accordingly, the application dated 13th August 2014 was dismissed with costs in the cause.
