The court accepted the plaintiff's evidence that the defendant used the insured vehicle to carry unauthorized passengers and failed to disclose this material fact when obtaining the policy. Consequently, the plaintiff was entitled to avoid the policy under Section 10(4) of Cap 405 and was not liable to indemnify the defendant for claims by passengers injured or killed in the accident....
