The High Court's jurisdiction to extend time for giving notice of intention to appeal is limited to situations where the Notice of Appeal has not yet been filed. Section 7 of the Appellate Jurisdiction Act empowers the High Court to extend time for giving notice, but does not grant authority to regularise or validate a Notice of Appeal already filed out of time. Once a Notice of Appeal is filed outside the prescribed period, only the Court of Appeal, under Rule 4 of the Court of Appeal Rules, has the power to extend time or deem such a Notice as properly filed.
