Ratio Decidendi

The court found that the applicants had provided sufficient grounds for the exercise of its discretion to grant leave to appeal out of time, having considered the reasons for delay and the absence of undue prejudice to the respondent. On the issue of stay of execution, the court held that the applicants were entitled to stay pending appeal, but only on the condition that the entire decretal sum is deposited in court within 45 days. The court further directed that the appeal must be prosecuted within 90 days, failing which it would stand dismissed with costs to the respondent. The court thus balanced the interests of both parties by granting conditional stay and leave to appeal out of time.
