The Plaintiffs failed to prove that the outstanding balance of USD 111,317.50 for the 6 prime movers was paid to the Defendant. The evidence showed that only USD 557,648 was paid by the financier, and the Plaintiffs did not provide proof of payment for the balance. The 9 cheques issued by the Plaintiffs were returned unpaid, and the Plaintiffs' claim that these were for a tractor was unsubstantiated. As payment for the balance was not made before the commencement of the Value Added Tax Act No. 35 of 2013, the Plaintiffs are liable to pay 16% VAT on the outstanding sum.
