The court found that the Ethics and Anti-Corruption Commission was not a party to the contract or the arbitral proceedings and that its interest was limited to investigations into the regularity of the contract. The issues the Commission sought to raise had already been canvassed and determined during the arbitration, and the Commission had been aware of the proceedings but failed to intervene at the appropriate stage. At the enforcement stage, only parties to the arbitration have standing, and the Commission's joinder would not assist the court or add value. The application for joinder was therefore dismissed as lacking merit.
