The Transition to Devolved Government Act, 2012, provided a clear statutory mechanism for the transfer of assets, liabilities, and pending suits from defunct local authorities to County Governments, to be managed by the Transition Authority. There was no evidence that the present suit was inventorised and transferred to the County Government of Baringo by the Transition Authority before its mandate lapsed on 4th March 2016.
