Ratio Decidendi

The court held that PW 2, as the maker of the treatment chit and the person who treated the respondent, was competent to produce the document in court, regardless of her employment status at the time of testimony. Section 35(1)(a)(ii) and (b) of the Evidence Act permits the maker of a document to tender it in evidence if called as a witness and having personal knowledge of the facts. The appellant had the opportunity to cross-examine PW 2 on the document's contents. The trial magistrate did not err in dismissing the objection, and the grounds of appeal lacked merit. The appeal was dismissed, and the matter was directed to proceed expeditiously in the lower court.
