Given the lack of conclusive evidence of ongoing income at the time of death, the court held that a global award for loss of dependency was more appropriate than a calculation based on the disputed multiplicand and multiplier. The court also determined that the trial court failed to properly account for the risk of double compensation between the Law Reform Act and Fatal Accidents Act awards.
