Ratio Decidendi

The Court of Appeal found that the applicants had demonstrated both an arguable appeal and that the appeal would be rendered nugatory if stay was not granted. The arguable issue was whether the respondents were rightful employees of the 1st applicant. On the nugatory aspect, the court was satisfied that public funds would be at risk if the disputed emoluments were paid out, as the respondents may not be able to refund the sums if the appeal succeeded. The court therefore exercised its discretion to grant a stay of execution of the judgment and all consequential orders of the Employment and Labour Relations Court pending the hearing and determination of the intended appeal.

Court Disposition

Application allowed. Stay of execution granted pending appeal.

  • An order of stay of execution of the judgment and all consequential orders of the Employment and Labour Relations Court in Nakuru ELRC Cause No 382 of 2013 dated October 21, 2021 is issued pending the lodging, hearing and determination of the intended appeal.
