The grounds of appeal were not frivolous and warranted determination by the Court. The respondent had not shown that he was in a financial position to refund the decretal sum if paid and the appeal succeeded. Given the colossal amount involved and the absence of evidence of the respondent's ability to refund, the Court was satisfied that the threshold for granting a stay of execution had been met. Consequently, the application for stay was allowed pending the hearing and determination of the appeal.
