Miscellaneous Application / Ruling on Application for Review of Previous Ruling

  1. 1 Whether the applicant has met the threshold for review or setting aside of the ruling delivered on 3rd October, 2024.
  2. 2 Whether there was an error apparent on the face of the record in the court's failure to consider prayer No. 3 in the application dated 28/8/2024.

Ratio Decidendi

The court found that the applicant's assertion of an error apparent on the face of the record was unfounded. Prayer No. 3 in the application dated 28/8/2024, which sought a temporary injunction, had already been overtaken by events and was spent at the time of the previous ruling. The court held that there was no mistake or error apparent on the face of the record, nor any other sufficient reason to warrant review or setting aside of the ruling delivered on 3rd October, 2024. The applicant failed to meet the threshold for review as set out in Section 80 of the Civil Procedure Act and Order 45 Rule 1 of the Civil Procedure Rules. The application was therefore dismissed.
