Ratio Decidendi

The court found that the only reason advanced by the applicants for not filing the memorandum of appeal within the statutory thirty-day period was lack of funds to pay their advocate. The court held that this is not a satisfactory or reasonable explanation, as parties are presumed to have filing fees when moving the court and can file pleadings in person. Consequently, the court declined to grant leave to file the appeal out of time. As the prayer for extension of time failed, the prayer for stay of execution could not be considered. The application was dismissed with costs.
