The court held that the Chief Magistrate's Court lacked jurisdiction to entertain or determine an application seeking to set aside or vary a judgment, ruling, or order of the High Court. The hierarchy of courts as established by the Judicature Act and the Magistrates Courts Act makes it clear that subordinate courts cannot review or alter decisions of the High Court. Any orders issued by a magistrate in purported exercise of such jurisdiction would be a nullity. Consequently, the exparte application filed in the Chief Magistrate's Court seeking reinstatement of the suit after the High Court's judgment was incompetent and was struck out.
