The application for stay of proceedings pending appeal fails because the applicant did not file a draft memorandum of appeal to demonstrate the grounds of the intended appeal, making it impossible for the court to assess whether the appeal is arguable or not frivolous. Additionally, the applicant failed to seek leave to appeal, which is a mandatory prerequisite for appealing a High Court decision in succession matters. Without leave, any order for stay would be in vain.
