Ratio Decidendi

The court found that the application for stay of execution was filed after the decretal sum had already been paid out by the garnishee to the petitioner. As such, the order sought to be stayed had already been executed, rendering the application moot and not justiciable. The court relied on the principle that courts cannot restrain or undo acts that have already occurred, as articulated in Macharia Kagio v Habiba Ahmed Mohammed [2014] eKLR. The application was therefore dismissed with costs for being overtaken by events.
