The court held that although the applicant's counsel did not demonstrate unusual facts or provide evidence of overwhelming chances of success, the prosecution did not oppose the application for bail pending appeal. The applicant, an Administration Police Officer with a known abode and family responsibilities, had complied with previous bond terms. The court also noted that the medical evidence at trial was not conclusive.
