Procedural Posture

Miscellaneous Application / Ruling on Interlocutory Injunction

  1. 1 Whether the plaintiff/applicant has made out a good case to warrant the grant of a temporary injunction.
  2. 2 Who should bear the costs of the application.

Ratio Decidendi

The court found that the plaintiff demonstrated a prima facie case with a probability of success, supported by documentary evidence of ownership and proof of payment. The 2nd defendant admitted the plaintiff's purchase, and the 1st defendant failed to provide evidence of his own claim. The court was satisfied that the plaintiff would suffer irreparable harm if the construction continued, as damages would not be an adequate remedy. Applying the principles in Giella v Cassman Brown, the court granted a temporary injunction to preserve the status quo pending determination of the main suit.

Court Disposition

temporary injunction granted

  • The costs of this application do abide the outcome of the main suit.
