Ratio Decidendi

The court found that although the delay in filing the application was inordinate, there was no evidence the applicant was aware of the judgment before his advocate received notice on 5th February 2018. The court gave the applicant the benefit of doubt and accepted the explanation for the delay. On the issue of stay, the court held that the applicant must provide security for the decretal sum and that the appeal raised issues on both quantum and liability. The court therefore granted leave to appeal out of time and allowed the stay of execution, conditional upon the applicant depositing the whole decretal sum in court within 30 days. Failure to comply would result in lapse of the stay order.
