Ratio Decidendi

The court found that the dispute arose from an employer-employee relationship and concerned an injury sustained in the course of duty. By operation of the Constitution, the Employment and Labour Relations Court Act, and the Employment Act, jurisdiction over such matters lies exclusively with the Employment and Labour Relations Court. The High Court, therefore, lacks jurisdiction to hear and determine the suit. In line with appellate authority, rather than striking out the suit, the court ordered its transfer to the Employment and Labour Relations Court to serve the interests of justice and avoid undue procedural technicalities.
