Ratio Decidendi

The court held that the claim for unfair termination was statute barred because the cause of action accrued on the date of dismissal, 22 February 2010, and the claim was filed outside the three-year limitation period prescribed by section 90 of the Employment Act, 2007. The court distinguished between claims for unfair termination and claims for terminal dues, finding that the latter could be severed and were not time-barred due to the Respondent's acknowledgment of debt in a letter dated 1 April 2014. Consequently, the Claimant was only entitled to the acknowledged sum for salary for days worked and pending leave, but not to compensation or pay in lieu of notice for unfair termination.
