Ratio Decidendi

Although the claimant was dismissed on 22nd February 2010 and the statutory limitation period of three years would ordinarily have expired on 21st February 2013, the respondent's letter dated 1st April 2014 acknowledged the claimant's entitlement to final dues. This acknowledgement triggered Section 23(3) of the Limitation of Actions Act, resulting in a fresh accrual of the right of action from the date of the letter. Consequently, the claim filed on 19th March 2014 was within the limitation period, and the respondent's application to strike out the claim on grounds of limitation fails.
