The court found that the appellant, having failed to call any witnesses or present evidence to challenge the respondent's account of the accident, could not contest liability on appeal. The only eyewitness testimony supported the respondent's version that the appellant's vehicle caused the accident while the respondent's vehicle was parked. The trial magistrate was correct in holding the appellant wholly liable. On quantum, the court agreed with the appellant that loss of user cannot be awarded for an indefinite period and must be based on reasonable estimation.
