The court held that while the appellant failed to strictly prove the repair costs due to lack of receipts or proof of payment, the claim for loss of use was supported by uncontroverted testimony regarding the commercial nature of the vehicle and daily profits, warranting an award of Kshs. 2,000 per day for 30 days. The court also took judicial notice that a police abstract was not free at the time and allowed the claim for Kshs. 100. The trial court's decision was varied to award the appellant Kshs. 60,000 for loss of use and Kshs. 100 for the police abstract, in addition to the previously awarded Kshs. 5,000 for assessor's fees. The appellant was also awarded costs of the appeal.
