The respondents had failed to follow the proper procedure for challenging a taxing officer's decision, which is by way of reference under paragraph 11 of the Advocates Remuneration Order, not by appeal under the Civil Procedure Rules. The court found that the order of Kihara Kariuki J was spent once the respondents complied with it by appearing before the taxing officer, and thus there was nothing left to review.
