The court held that the only competent procedure for challenging a taxing officer's decision on an advocate-client bill of costs is by way of reference under paragraph 11 of the Advocates Remuneration Order, not by appeal under the Civil Procedure Rules. The respondents, having already complied with the order of Kihara Kariuki J by appearing before the taxing officer, could not seek review of that order as it was spent. The purported appeal by chamber summons was incompetent and a nullity, as the Advocates Remuneration Order does not contemplate such an appeal.
