Procedural Posture

Civil Appeal / Ruling on Application to Strike Out Record of Appeal

  1. 1 Whether the record of appeal should be struck out for being filed out of time without leave of court.
  2. 2 Whether the application to strike out the appeal was itself filed within the prescribed timelines under the Court of Appeal Rules.

Ratio Decidendi

The court found that while the appellants failed to seek leave to file the record of appeal out of time, the application to strike out the appeal was itself filed outside the thirty-day period prescribed by Rule 84 of the Court of Appeal Rules. The record of appeal was served on 26th January 2018, making the deadline for filing the application 26th February 2018. The application was filed on 27th February 2018, one day late. As a result, the application was time-barred and incompetent, and the court dismissed it with costs to the appellants, notwithstanding its merits.

Court Disposition

application dismissed with costs to the appellants

Orders

  • The application to strike out the record of appeal is dismissed as incompetent.
