Ratio Decidendi

The court found that the claimant was not a new employee but had been in continuous service since 2012, and the probationary period in the 2015 contract was invalid and superfluous. The respondent failed to provide the required notice or pay in lieu of notice prior to termination, and did not afford the claimant a hearing as required by the Employment Act. The court held that the termination was therefore unfair and unlawful. Claims for underpayment of wages and accrued leave were dismissed for lack of proof. The claimant was awarded compensation equivalent to three months' salary and one month's salary in lieu of notice, but denied costs for late filing of submissions.
