Ratio Decidendi

The Tribunal found that there was insufficient evidence to establish that the Landlord unlawfully locked the Tenant's premises, as the issue was not pursued after an earlier order to reopen the premises was complied with. The Tenant admitted to owing substantial rent arrears and to having locked the premises himself due to lack of business. The Tribunal determined that the tenancy relationship had effectively collapsed, with the Tenant no longer in occupation and not paying rent. Exercising its powers under section 12(4) of Cap 301, the Tribunal ordered the Tenant to vacate the premises forthwith and pay all outstanding rent, dismissing the Tenant's complaint with costs to the Landlord.
