The Court found that the Respondent failed to prove that it communicated the termination of employment to the Claimant in 2013. The Claimant only became aware of the termination in 2018, and thus the claim was not time-barred. The Respondent's action to terminate employment without a fresh disciplinary process, after the discontinuation of the initial proceedings pending the outcome of criminal charges, was procedurally unfair and contrary to sections 41 and 45(4)(b) of the Employment Act, 2007. The Claimant was entitled to compensation equivalent to 10 months' gross salary, and any dues set out in the termination letter if unpaid.
