Ratio Decidendi

The court found that while the Plaintiffs had demonstrated that some of the suit properties are still registered in the name of Kagaa Farmers Cooperative Society Limited, the appointment of the liquidator for the Society had been stayed by a High Court order pending the determination of an appeal. As such, there was no liquidator in office at the time of the application. Enjoining a non-existent liquidator would be futile and would contravene the subsisting court order. Consequently, the application to enjoin the liquidator and to amend the plaint in terms of the draft amended plaint lacked merit and was dismissed.
