Ratio Decidendi

The High Court found that the dispute concerned the business of a co-operative society and involved persons claiming through a deceased member. Section 76(1)(a) of the Co-operative Societies Act therefore applied, mandating that such disputes be referred to the Co-operative Societies Tribunal. As a result, the High Court lacked jurisdiction to entertain the suit. The court held that where jurisdiction is wanting, all other issues, including abatement and amendment, are rendered moot. Consequently, the suit was struck off without any order as to costs, and the parties were directed to file their claim before the appropriate Tribunal, subject to any limitation period.
