Ratio Decidendi

The court found that the claimant was not an employee of the respondent at the time of his dismissal, as the respondent's contract with the National Cereals and Produce Board had expired on 31st May 2015. The evidence showed that the claimant's alleged dismissal occurred on 31st December 2015 and was effected by the NCPB manager, not the respondent. Applying the control test, the court held that the respondent no longer had control over the claimant's employment at the material time. Consequently, the respondent could not be held liable for the alleged unfair termination, and the claimant was non-suited against the respondent. The suit was dismissed, with each party bearing their own costs.
