Procedural Posture

Succession Cause / Ruling on Application for Release of Compensation Funds, Documents, and Appointment of Administrator

  1. 1 Whether the applicant is entitled to the release of Kshs.2,000,000 allegedly awarded as compensation in a civil suit.
  2. 2 Whether the applicant is entitled to the release of certain documents from the advocate.
  3. 3 Whether the applicant should be appointed administrator of the estate in place of the deceased previous administrator.

Ratio Decidendi

The court found that the application was wholly unmerited. The civil suit for compensation was dismissed, and therefore no compensation funds existed for release or deposit. The applicant lacked locus standi in this cause as he was not the holder of the operative grant, which had been issued to Mary Muthoni Kirehu, now deceased. The applicant was already the administrator of the estate by virtue of a grant in a separate cause (HCSC No. 1398 of 2008), making further appointment unnecessary. The court consolidated the two succession causes, revoked the inoperative grant to the deceased administrator, and affirmed the applicant's existing grant as administrator of the estate.

Court Disposition

Application dismissed with costs. Succession causes consolidated. Grant to deceased administrator revoked. Applicant's grant affirmed.
