Procedural Posture

Injunction Application / Ruling on Interlocutory Injunction

  1. 1 Whether the plaintiff has established a prima facie case for the grant of an interlocutory injunction against the defendant.
  2. 2 Whether damages would be an adequate remedy for the plaintiff if the injunction is not granted.
  3. 3 Whether the balance of convenience favours the grant of an injunction.

Ratio Decidendi

The plaintiff, as the registered proprietor of the suit properties, has demonstrated a prima facie case with a probability of success. The defendant has not provided any explanation or justification for his entry and use of the land. The plaintiff stands to suffer loss if the defendant continues to interfere with the land, and damages would not be an adequate remedy given the proprietary nature of the rights involved. The application for interlocutory injunction is therefore allowed to preserve the status quo pending the hearing and determination of the suit.
