The tribunal's decision to apportion and order subdivision of the registered land was therefore a nullity. The Provincial Appeals Committee erred in upholding an award made without jurisdiction, and the subsequent adoption of the tribunal's award as a court order was invalid. The appeal was properly before the High Court as it raised a point of law regarding jurisdiction. Consequently, the orders of the tribunal, the Appeals Committee, and the adoption of the award as a court order were set aside.
