Procedural Posture

Criminal Revision / Ruling on Application for Revision of Sentence

  1. 1 Whether the High Court has jurisdiction to review or revise its own sentence imposed in a criminal case.
  2. 2 Whether the period spent in custody pending trial should be considered in sentencing by the High Court.

Ratio Decidendi

The High Court lacks jurisdiction to review or revise its own sentence or orders in criminal matters. The statutory and constitutional provisions cited (sections 362-367 of the Criminal Procedure Code and Article 165(6) and (7) of the Constitution) restrict the High Court's revisionary and supervisory powers to subordinate courts and do not permit the High Court to exercise such powers over its own decisions or those of courts of parallel jurisdiction. Therefore, the applicants' request for sentence review is not properly before the court, and their remedy lies in filing an appeal to the Court of Appeal.

Court Disposition

application dismissed for want of jurisdiction

Orders

  • The application for revision of sentence is dismissed for want of jurisdiction.
  • The applicants are advised to file an appeal in the Court of Appeal.
