The court found that although the plaintiff was the registered proprietor of the suit land, the root of his title was fatally defective. The land in question had been set aside for forest purposes following a land exchange program between the Settlement Fund Trustee and the Forest Department in 1979. The intention to declare the area a forest was published in Gazette Notice No. 3600 of 1993 and was never rescinded. By the time the plaintiff purported to acquire the land in 1999, the Settlement Fund Trustee had no authority to allocate it, as it was already reserved for forest use.
