The Tribunal found that while there was an agreement for the tenant to recover construction costs from rent, the tenant failed to provide evidence of payment of the outstanding rent balance. The tenant did not pay rent from February 2020 except for Kshs.100,000 paid pursuant to a Tribunal order. The tenant was served with a notice to terminate tenancy but failed to file a reference as required by law, resulting in the notice taking effect. The restraining orders previously granted did not prevent the landlord from demanding rent.
