Ratio Decidendi

The court found that the respondent's refusal to sign the mutation forms was not legitimate, as the daughters of the deceased and the children of the deceased daughters had expressly filed consents indicating they were not interested in inheriting from the estate. The respondent's objections were therefore unfounded. The court held that the grant should be rectified to reflect the substitution of a deceased beneficiary as per the consent recorded in court, and that the respondent must sign the necessary documents to facilitate distribution. In default, the Deputy Registrar was empowered to execute the documents on his behalf. The applicants were awarded costs.

  • The respondent shall within 14 days sign the mutation forms and any other documents necessary to enable distribution of the property among the beneficiaries.
