The Court noted that the parties had previously agreed to have the matter determined on the basis of filed evidence and submissions, and could not later resile from that agreement. There was no error or mistrial, and the process followed was lawful. However, the Court recognized that the Respondents had admitted owing the Claimant Kshs. 24,000/= in salary arrears and leave pay, and ordered payment of this sum in the interests of justice. The review application was otherwise dismissed.
