The court found that the applicant failed to prosecute the application by not filing written submissions as directed, rendering the application liable to dismissal for want of prosecution. Additionally, the respondent was not the administrator or holder of the grant sought to be revoked, and the administrator, Beatrice Wakii Njuku, was deceased. As such, the prohibitory and injunctive orders could not be properly issued against the respondent. The court therefore dismissed the application with costs to the respondent and vacated the interim orders previously granted.
