The Court found that while the intended appeal raised at least one arguable issue regarding the process and lawfulness of the applicant's suspension, the applicant failed to demonstrate that the appeal would be rendered nugatory if the injunction was not granted. The applicant was already out of office and the recruitment process for a new Clerk had commenced, making the injunction futile. The Court reiterated that it will not grant orders to restrain actions that have already occurred, and if the appeal ultimately succeeds, the applicant could seek compensation. Therefore, the application for injunction failed on the second limb of the test under Rule 5(2)(b) and was dismissed.
