Since the plaintiffs alleged discovery of the fraud in 2013 and filed suit in 2014, the claim was not time-barred. Furthermore, the defendant had not pleaded limitation in the defence nor indicated an intention to raise a preliminary objection on that ground. The court held that a preliminary objection cannot be sustained where facts are disputed and where the issue of limitation has not been pleaded. The defendant's preliminary objection was therefore without merit and was dismissed with costs.
