Ratio Decidendi

The court found that the Respondent failed to provide evidence of issuing a termination notice or of the Claimant's alleged absenteeism. The positive recommendation letter issued to the Claimant contradicted the Respondent's claims of misconduct. The Respondent did not observe the mandatory procedural fairness requirements under Section 41 of the Employment Act, 2007, nor did it establish a justifiable cause for termination as required by Section 43. Consequently, the termination was unlawful. The Claimant was awarded four months' salary as compensation, one month's salary in lieu of notice, and leave pay for two years. The claim for severance pay was dismissed for lack of basis.
