Ratio Decidendi

The court found that the application dated 18 November 2019 was filed by a law firm that was not properly on record at the time of filing, as the notice of appointment was only filed on 19 November 2019. Furthermore, there was no evidence of compliance with Order 9 Rule 9 of the Civil Procedure Rules, which governs the procedure for an advocate to come on record after judgment. As such, the application was incompetent and could not be entertained, regardless of its substantive merits. The court therefore struck out the application with costs to the respondent.
