Ratio Decidendi

The court found that the applicant had disclosed an arguable case for judicial review, as the contention that the court became functus officio after adopting the LDT award as a judgment raised a legitimate issue. The procedural defect of filing a notice of motion instead of a chamber summons was not fatal to the application and did not prejudice any party. The court held that the application had merit and granted leave to apply for orders of certiorari and prohibition as sought in prayers 2 and 3 of the amended notice of motion. Each party was ordered to bear their own costs.
