Ratio Decidendi

The court found that the Respondent failed to provide and prove valid reasons for the Claimant's termination, as required by Section 43 of the Employment Act. Additionally, the Respondent did not follow the mandatory due process stipulated in Section 41, which includes explaining the reasons for termination and allowing the employee to respond. The absence of both substantive justification and procedural fairness rendered the dismissal unfair and unlawful under Section 45(2) of the Employment Act. Consequently, the Claimant was entitled to compensation for unfair termination, notice pay, accrued leave, a certificate of service, and costs of the suit.
