The court found that the issues raised in the present suit are identical to those determined in Eldoret SRMCC Land Case No. 62 of 1986 and Eldoret High Court Civil Appeal No. 3 of 1987, involving the same parties (Kaptobon and Kipsaiya clans, with individual members added). The High Court, as at 1987, had jurisdiction to determine the dispute, and its decision was final. The addition of individual clan members does not alter the application of res-judicata. The Environment and Land Court, having concurrent jurisdiction, cannot reopen matters already conclusively determined.
