Procedural Posture

Employment Cause / Judgment

  1. 1 Whether the termination of the claimant's employment was unfair.
  2. 2 Whether the claimant is entitled to payment during the period of suspension.
  3. 3 Whether the claimant is entitled to a certificate of service.

Ratio Decidendi

The court found that the claimant, having been convicted on the second charge and having declined the conditions for lifting his suspension, was not unfairly terminated. The terms of the lifting of suspension were proportionate in light of the conviction. The claimant was not entitled to payment during the suspension period as he was not exculpated. The court applied the principle that entitlement to pay during suspension depends on the outcome of disciplinary proceedings. Since the claimant was found culpable and declined re-engagement, his claims for payment and compensation failed. However, he was entitled to a certificate of service, and each party was to bear its own costs.

Court Disposition

Claim largely dismissed; certificate of service to be delivered; each party to bear own costs.

Orders

  • Each party to bear own costs of the suit.
  • The respondent to deliver the claimant’s certificate of service within 7 days.
